What prenuptial agreement means
A prenuptial agreement is a couple deciding in advance what happens to their property if the marriage does not last.
It typically records what each person brings in, how assets acquired during the marriage would be treated, and what each would leave with. People make them where there is a business, inherited property, children from an earlier relationship, or a significant imbalance in assets.
In Nigeria the honest position is that a prenup is persuasive rather than automatically binding, and understanding that difference matters before anybody signs one.
How it is used
It is signed before the marriage, ideally well before, with each party having had the chance to take independent advice and to disclose what they own.
Those two features, disclosure and independent advice, are what give an agreement weight. A prenup produced the week before the wedding, with one party unadvised and no financial disclosure, invites the argument that it was signed under pressure and without understanding.

How this works in Nigeria
Nigerian courts have not treated prenuptial agreements as automatically enforceable in the way some jurisdictions do. The court retains discretion over property adjustment on divorce.
What a well made prenup does is provide evidence of what the parties intended and agreed when they were on good terms, and courts can and do take that into account. Where the agreement was fair, properly disclosed and independently advised, it carries far more weight than one that looks one sided.
Prenuptial vs postnuptial agreement
A prenuptial agreement is made before the marriage. A postnuptial agreement is made after it, sometimes when circumstances change, such as one spouse inheriting or starting a business.
The legal treatment in Nigeria is similar for both, meaning persuasive rather than automatically binding. Postnuptial agreements can face an additional challenge, which is that the parties are already married and the pressures on a spouse asked to sign may be greater. Independent advice matters even more there.
Limits and risks
The clearest limit is children. A prenup cannot fix custody, access or child maintenance in a way that binds a court, because the court decides those questions on the child's welfare at the time.
An agreement can also be undermined by circumstances at signing. Pressure, absence of disclosure, no independent advice, or terms so one sided that they are obviously unfair all reduce the weight a court will give it.
Worth knowing
Sign well before the wedding, disclose everything, and make sure each side has their own lawyer. A prenup signed days before the ceremony is the easiest kind to attack.
