What is a Power of Attorney?

A Power of Attorney (POA) is a legal document in which one person (the donor) authorises another person (the attorney or donee) to act on their behalf. It is widely used in Nigeria for property transactions, managing affairs while abroad, and handling financial or business matters when you cannot be present yourself.

When you need one

  • You are travelling or living abroad and need someone to manage property or business here.
  • You are buying or selling land and want a trusted person to sign and act for you.
  • You want someone to handle banking, tax or administrative matters on your behalf.

Key things a Power of Attorney should state

  • The donor and attorney and their addresses.
  • The exact powers granted — narrow (specific) or broad (general).
  • Whether it is revocable and how it can be revoked.
  • Duration, and any conditions.

A POA dealing with land usually needs to be properly executed and, in many cases, stamped and registered to be effective for property transactions.

Can I cancel a Power of Attorney?

Yes. A revocable POA can be cancelled by the donor at any time, usually by a written notice of revocation.
