What whistleblowing means

Whistleblowing is reporting wrongdoing that affects others or the organisation, rather than complaining about your own treatment.

That distinction is what separates it from a grievance. A grievance concerns how you are treated. A whistleblowing report concerns misconduct: fraud, theft, bribery, regulatory breach, falsification of records, danger to health and safety, or concealment of any of those.

The person reporting may not be personally affected at all. They may simply have seen something.

Two channels exist. Internal reporting, through the organisation's own policy to a named recipient. And external reporting, to a regulator, a law enforcement agency or a government programme.

The reason organisations build internal channels is straightforward: they would rather hear about a problem first and deal with it than read about it from a regulator.

What can be reported: the categories of conduct the policy covers.

Who to report to, and crucially an alternative recipient where the concern involves that person. A policy routing every report through the finance director is useless for a report about the finance director.

What happens next: who investigates, within what timeframe, and what the reporter is told.

Protection: an express statement that a person raising a concern in good faith will not suffer detriment, and that retaliation is itself a disciplinary matter.

And confidentiality, including the limits of it, because a report that leads to disciplinary or criminal proceedings may require the reporter's evidence.

For a person considering a report, the practical steps are to use the internal channel first where it is safe to do so, to keep records outside the organisation's systems, to report facts rather than conclusions, and to take advice before going external.

How this works in Nigeria

Nigeria's whistleblowing policy, introduced by the Federal Ministry of Finance in 2016, is the well known part. It offers a financial reward, expressed as a percentage of amounts recovered, to a person whose information leads to the recovery of stolen or concealed public funds or assets. It produced significant recoveries in its early years.

What Nigeria has not enacted is a comprehensive whistleblower protection statute. A bill has been under consideration for years, and until it passes, protection for a person who reports rests on general employment law rather than on a dedicated framework.

That gap matters. An employee dismissed or victimised after reporting wrongdoing would argue unfair dismissal or detriment at the National Industrial Court, which is a real remedy and a slower and less certain one than a statutory protection regime would provide.

Sector regulators have filled part of the gap. The Central Bank, the Securities and Exchange Commission and others require regulated institutions to maintain whistleblowing arrangements, and the Nigerian Code of Corporate Governance addresses it for public interest entities.

The practical advice for an employee is therefore cautious. Report in good faith, report facts you can support, keep your own records outside the organisation's systems, and take advice before going external, because the protection available to you is not as robust as the policy publicity suggests.

For organisations, a working internal channel is genuinely in their interest. Reports that go outside first are more damaging than reports handled internally.

Whistleblowing vs grievance vs the reward policy

Three related but distinct things.

A grievance is a complaint about your own treatment at work: pay, workload, a manager's conduct, harassment. The outcome affects your situation, and it goes through the grievance procedure.

Whistleblowing is a report about wrongdoing affecting others or the organisation: fraud, bribery, regulatory breach, danger. The reporter may not be affected at all, and it goes through a separate channel that should not run through the person implicated.

The federal whistleblowing policy is an external reward programme aimed at recovering public funds. It offers a percentage of amounts recovered on information leading to recovery, and it is a specific scheme rather than a general protection framework.

An employee reporting internal fraud at a private company is whistleblowing. One reporting concealed public funds may also fall within the reward policy. One complaining about their own salary is raising a grievance.

Limits and risks

The absence of comprehensive statutory protection is the central limitation. A reporter relies on general employment law remedies rather than on a dedicated regime.

Anonymity is also difficult to maintain in practice, particularly in small organisations where the source of a report is often obvious from its content.

Investigations can also fail to reach a conclusion, and a reporter who takes a serious risk and sees nothing happen is unlikely to report again.

Retaliation is often indirect: a reassignment, an exclusion, a poor appraisal, a role that quietly disappears. Those are harder to challenge than an outright dismissal.

And bad faith reporting is a real risk for organisations, which is why policies protect reports made in good faith rather than every report.
