Judgment

A judgment is the court's decision in a case. Winning one is not the same as being paid, because enforcement is a separate process that begins after the judgment is delivered.

What judgment means

A judgment is the court's answer to the dispute.

It decides who wins and what they get, and it converts an argument into an obligation. The person entitled becomes the judgment creditor, and the person liable becomes the judgment debtor.

There are several kinds. A money judgment orders payment of a sum. A declaratory judgment states the legal position, such as who owns a piece of land, without necessarily ordering anybody to do anything. An injunctive order requires somebody to do or stop doing something. A consent judgment records terms the parties agreed and asks the court to enter them, which makes a settlement enforceable as a judgment. A default judgment is entered where a defendant fails to respond within the time allowed.

What a judgment does not do is produce money. That is enforcement, and it is a separate exercise.

How it is used

After judgment the practical question is collection, and Nigerian law offers several routes.

Garnishee proceedings attach money held for the debtor by a third party, usually a bank, and are the fastest route where an account can be identified.

A writ of fieri facias authorises seizure and sale of the debtor's property to satisfy the judgment.

A judgment summons brings the debtor to court to be examined about their means and can lead to instalment orders.

Where the judgment ordered something other than payment, enforcement may be by committal for contempt, or by an order for possession where land is involved.

The losing party's options run in parallel. An appeal must be filed within the time the rules allow, and an appeal by itself does not stop enforcement. A separate application for a stay of execution is needed, and the court decides whether to grant it. Judgment creditors move quickly for exactly this reason.

How this works in Nigeria

The gap between winning and being paid is the defining Nigerian experience of litigation.

A judgment against a solvent private company with identifiable bank accounts is usually collectable through garnishee proceedings. A judgment against a person with no traceable assets, or against a public body, can be far harder, and in the case of public funds the Attorney General consent requirement adds a real obstacle.

Time is the other issue. Nigerian litigation is slow, appeals extend it further, and a claim begun in one year may be finally resolved years later. That reality is why demand letters, mediation and negotiated settlements are worth taking seriously before issuing proceedings.

Consent judgments deserve more use than they get. Where parties settle, recording the terms as a consent judgment means the settlement is directly enforceable rather than requiring a fresh action if it is breached.

Judgments also have a shelf life for enforcement purposes. Execution after an extended period generally requires leave of the court, so a creditor who wins and then does nothing for years creates an extra hurdle.

Judgment vs settlement vs consent judgment

Three ways a dispute ends, with very different enforcement consequences.

A judgment is imposed by the court after the case is decided. It is directly enforceable, it can be appealed, and getting there took the full length of the proceedings.

A settlement is an agreement between the parties, usually recorded in a settlement agreement and often accompanied by discontinuance of the case. It is a contract. If the other side breaches it, you sue on the contract, which means starting again.

A consent judgment records the settled terms and enters them as a judgment of the court. You get the speed and control of a settlement with the enforceability of a judgment, and breach leads straight to enforcement rather than to a new case.

Where a case settles, asking the court to enter the terms as a consent judgment costs little and is usually the better choice.

Limits and risks

A judgment is only worth what the debtor can pay. Against a defendant with no assets it is a document and nothing more.

Enforcement against public bodies is constrained by the consent requirement for public funds, which is the most common Nigerian complaint about judgments.

Appeals extend matters considerably, and while an appeal does not automatically stay execution, a stay granted pending appeal can hold a creditor for a long time.

Declaratory judgments also do not enforce themselves. A declaration that you own land does not remove anybody from it, and a further order for possession is needed.

And enforcement after long delay requires leave, so a judgment left unenforced becomes harder to act on.

Worth knowing

Apply for garnishee orders immediately after judgment, before the debtor reacts. Judgment creditors who wait for the appeal window to close often find the accounts empty when they finally move, and the judgment then has to be enforced the slow way or not at all.
