What change of name means
Changing your name is a matter of adopting a new name and being consistent about it.
Nigeria has no single registry of names. There is no central authority that issues a new identity. What the process does is create evidence that you have abandoned one name and adopted another, so that institutions holding your records can update them.
That evidence comes in two parts.
A sworn declaration, made before a commissioner for oaths, stating your former name, your new name, that you have permanently renounced the former, and that all documents in the former name refer to you.
And publication in a newspaper, giving public notice of the change.
Neither of those changes anything by itself. They are what you present to each institution so that it changes its own records. The actual work is the updating, and it is the part people underestimate.
How it is used
The sequence in practice is settled.
Swear the declaration of change of name before a commissioner for oaths at a High Court registry, taking valid identification. Obtain several stamped copies, because institutions keep them.
Publish the notice in a national newspaper. Keep the original page, not a photocopy, and keep several copies of it.
Then notify, in a sensible order: the National Identity Management Commission for the national identification record, the bank, the passport office, the employer and pension administrator, the tax authority, professional bodies, schools and universities for certificates, insurers, and the Corporate Affairs Commission where you are a director or shareholder.
Each institution has its own form and its own requirements, and most will want the affidavit, the newspaper page and identification.
Marriage is treated differently. A woman adopting her husband's surname on marriage generally uses the marriage certificate rather than a change of name affidavit, and institutions accept it. Reverting after a divorce may require the decree, and some institutions ask for an affidavit as well.
Key features
- No central names registry; the process creates evidence rather than a new identity
- A sworn declaration before a commissioner for oaths is the first step
- Newspaper publication gives public notice
- Every institution must be notified separately with its own form
- Marriage name changes usually rely on the marriage certificate
- Company name changes go through the CAC by a different route
How this works in Nigeria
The practical difficulty is institutional rather than legal, and it is worth planning for.
Documents in the old name accumulate over a lifetime: school certificates, degree certificates, professional qualifications, land documents, share certificates, insurance policies, bank accounts and the national identification record. Each has its own holder and its own process, and some of them, particularly universities and older institutions, are slow.
Start with the national identification record and the bank, because most other institutions will ask to see updated identification.
Keep the affidavit and the newspaper page permanently. They will be requested for years, including in property transactions where a name on an old title document does not match the current one.
That mismatch is the point where a change of name most often causes real difficulty. A person who bought land in 2009 under a former name, and now sells under a new one, needs the affidavit and publication to link the two, and a buyer's lawyer will insist on it.
For company officers, the CAC filing matters. A director whose name changed should file the change so the company's records and the status report match their identification, because a mismatch delays bank and regulatory processes for the company.
A company changing its own name is a separate process entirely: a special resolution, a name availability check and a filing at the CAC, which issues a certificate of change of name. The original certificate of incorporation stands.
Change of name vs correction of name vs company name change
Three different things, requiring three different processes.
A change of name is adopting a new name in place of a former one. It uses a sworn declaration, newspaper publication and institutional updates.
A correction of name addresses an error: a misspelling on a certificate, a transposed order of names, or two records showing variants of the same name. It is usually handled by a declaration confirming that the differently spelled names refer to the same person, and by the issuing institution's own correction process.
A company change of name is a corporate act. It requires a special resolution of the members, a name availability check and a filing at the Corporate Affairs Commission, which issues a certificate of change of name. The original certificate of incorporation stands unchanged.
The first two are frequently confused. A person whose name is simply misspelled on one document does not need a change of name; they need a declaration that the two spellings refer to the same person.
Limits and risks
The process creates evidence rather than a clean break. Documents in the former name continue to exist, and the affidavit and publication are what link them.
Institutional updating is slow and inconsistent, and some bodies impose requirements beyond the affidavit and publication.
A change of name also does not affect obligations. Debts, judgments, court proceedings and contractual liabilities follow the person, not the name.
And it cannot be used to escape anything. Changing a name to avoid a creditor or a court is not effective and creates its own exposure.
Worth knowing
Keep the original newspaper page and stamped affidavit permanently, not a photocopy. Nigerian property transactions stall years later when a name on an old title document does not match the seller's current identification, and those two documents are what reconcile them.
Questions people ask
How do I change my name in Nigeria?
Swear a declaration of change of name before a commissioner for oaths, publish the change in a national newspaper, then notify each institution holding your records with its own form and requirements.
Is there a central registry for name changes?
No. Nigeria has no single registry of names, so the process creates evidence that you have adopted a new name rather than issuing a new identity. The work is in updating each institution.
Which institutions should I notify first?
The national identification record and your bank, because most other institutions will ask to see updated identification before they will process a change.
Do I need an affidavit to take my husband's surname?
Usually not. Institutions generally accept the marriage certificate for a name change on marriage. Reverting after divorce may require the decree, and some institutions also ask for an affidavit.
My name is spelled differently on two documents. Do I need a change of name?
No. That is a correction rather than a change. A declaration confirming that the differently spelled names refer to the same person, together with the issuing institution's correction process, is what is needed.
How do I change a company name?
By special resolution of the members, a name availability check and a filing at the Corporate Affairs Commission, which issues a certificate of change of name. The original certificate of incorporation stands.
